Water Sports Disclaimer & Marine Craft Rental Agreement
The rental amount must be paid in advance. All Clients/riders should provide a passport or Emirates ID for the contract and signed by the agreed rider. (The rental/customer agreed to give his original passport or Emirates ID, to scan & hold until he comes back from his ride, and to prove his full commitment to this rental agreement clauses).
The customer is obliged to wear a life jacket at all times. The company is not responsible for any negligence in this respect, and in case he/she damages the life jacket, AED/850/ must be paid for the company, then he can keep the life jacket for himself.
Racing each other on the water Is Strictly Prohibited, as it can lead to harmful consequences, injuries, deaths, fines, and damages which customer is liable for all legal consequences, indemnifications, fees and charges.
The paid amounts for the reservations are non-refundable, and the customer/buyer/payer/Client has no right to claim them, and in case he/she does not attend on the specified date & time in the booking, he/she will lose the entire value of the paid amount if he/she does not re-book and attend the ride within a maximum of 14 days from the date of the payment made in Company location or via Company website/Payment gateway.
The customer must drive carefully, and shall not drive near the beach, nor than water less than ½ meters deep to avoid intake or sand or debris, and must maintain a 50-meter distance from designated swimming areas, and 15 Meters from any marine-craft, otherwise, the customer is liable for all legal consequences, indemnifications and fines, besides all the charges for repairing.
Clients/Riders take full responsibility for themselves and their safety. The company will not be liable for any negligence by the customer and must obey all the rules and regulations given by the staff and the company policies. Due to non – compliance the tour operator will cancel and report it immediately to the police/coast guards and will be taken back to the marina, the full cost will be applied with no refund.
The Client is liable for the Jet Ski key/Jet car/Water car. If the key is lost or damaged the amount for the key is AED /2,800/ for Sea Doo, but only AED /200/ for Yamaha/Water Car, which is payable immediately.
If the Customer/Renter enters the restricted area as mentioned in the instructions and the authority confiscates the equipment. The renter will be liable for the full price of the equipment as per mentioned in the insurance policy, and any financial or legal liability arising from this action which you will also pay for each Jet Ski/Jet Car becomes out of water/out of service “Not operating”, the indemnification is AED /3,000/ per Day.
The minimum age allowed on the Jet ski/Jet Car is /18/ years old unless accompanied by an adult full time, the minimum age of accompanied children is /10/, And the company will not be responsible for their safety.
The maximum limit for any compensation in the event of death or injury is what is decided by the insurance company that contracted with the company, hence, the company will not bear any claims or compensation, whatever their nature. If additional insurance is desired, the customer has the right to purchase it without consulting the company and at his own responsibility.
Pregnant ladies, weak hearts, persons under Alcohol, or any medicine that cause weak concentration are Not allowed to drive or ride a Jet ski/Jet Car at all times, to make sure it’s safe to ride in, as we do not hold any responsibility for accidents, damage, deaths.
All Clients/Riders must keep their belongings with them all the time, as our Staff/Company legally will not be liable for any claim such as missing, damaged, or misused belongings, such as phones, money, jewellery, documents etc.
In case of accident or any damage occurred during rental/customer driving, The Client/Rider/Customers must pay immediately AED 1,250 for scratches or dents, In case of damaged Hull must pay Minimum AED 9,000 In case of Hull & Engine are both Damaged, must Pay Minimum AED 16,000, Please, Note that Insurance does not cover minor damages AND The Above-mentioned amounts are a must & including: Insurance Liability, days off the water as the Jet ski/Jet Car is being repaired in the agency/workshop, And transportation cost of Jet Ski & Jet Car from the site to MTM, Al Yousuf Motors Or Workshop /Two Ways/. “Those amounts must be paid immediately or the Client/Customer will be legally reported to Law Force as per the rules & regulations in U.A.E. and he/she will be liable to pay all the additional cost/fees/wages for suing him for not paying for the company the amounts agreed on this agreement.
All Jet Skis/Jet Cars will be inspected with the client before leaving and inspected on return with the client. If there is damage the renter/client is responsible for paying the damages immediately upon return.
The hirer/driver/Client/Customer will also be liable in addition to the insurance excess liability the Jet Ski/Jet Car daily rates for every day the Jet Ski/Jet Car is not running on the water/operating, Hence, In simple terms, you will have to pay for every day it is NOT on the water until the equipment is totally repaired or replaced by the insurance as stated in clause 13.
The Clients/riders all must return to headquarters/beach 20 minutes earlier than the Sunset.
Renter(s) must report any damage, Renter(s) will be held responsible for any damage to the Jet ski / Jet Car that is not reported at the time of delivery, The marine-craft will be checked with clients before & after the renting/riding process.
I totally agree and understand that My partition in Jet Ski/Jet Car/Kayaks activity, as with any water sport, will test my physical and mental limits, involve very powerful machinery, and expose me to dangers associated with the operation of Jet ski/Jet Car/Kayak. These dangers include without limitations: collisions with other vessels, fixed objects, persons in the vessel, falling off the vessel, sinking of the vessel, drowning and other dangers known or unknown. I understand these rules and assume the risk of harm presented by these damages.
The Sea Hero Company reserves the right to cancel any rental due to inclement weather or unsafe circumstances. If a ride is cancelled due to bad weather, Sea Hero Company reserved the right to either prorate a monetary return in place of time lost or may issue a voucher for rental or another time and/or date.
I agree that I won’t allow any other person to operate the vessel that I am renting from Sea Hero Company unless that person is a Sea Hero Company Employee or Agent.
